Mapbreak Terms of Use
Effective date: Effective date
These Terms are an agreement between you and ScaleOn Limited ("we", "us") about the Mapbreak app and its service ("Mapbreak"). By using Mapbreak (for example by tapping "Get started"), you agree to these Terms and to our Privacy Policy (/privacy). Apple's Licensed Application End User License Agreement ("Standard EULA") also applies; if the two conflict, the Standard EULA controls the license to the app and these Terms control the service.
1. What Mapbreak does
Mapbreak takes a destination you share from Google Maps (or a Google Maps link you paste), suggests food, coffee, scenic and sightseeing stops along the drive based on your time budget and preferences, shows a route preview with estimated arrival times, and opens the route in Google Maps. Mapbreak is not a navigation app: turn-by-turn directions come from Google Maps. Mapbreak is designed for driving trips in the United States.
2. Safety first
- Don't use Mapbreak while driving. Plan before you leave, or let a passenger do it.
- Obey traffic laws, road signs and road conditions; they take priority over any suggestion.
- You decide whether a stop or route is safe, legal and suitable for you. Suggestions are not endorsements.
3. Information accuracy
Place details (ratings, review counts, hours, photos, prices) come from Google and other third parties, and travel times, minutes added and arrival times are estimates. They can be wrong or out of date: places close, hours change, roads get busy. Check before you rely on them. We are not responsible for third-party businesses you visit.
4. No account
You don't need to sign up. Mapbreak creates an anonymous ID on your device to talk to our servers and remember your free-route and Mapbreak Pro status. Your route history is stored on your device; if you delete the app or change phones, that history may be lost. Use "Restore purchase" to restore Mapbreak Pro on a new device with the same Apple Account.
5. Free plan and Mapbreak Pro
Free. Your first route plan is free: suggestions, stop details and the route preview. Opening routes in Google Maps and planning further routes require Mapbreak Pro.
Mapbreak Pro includes unlimited route plans, opening routes in Google Maps, up to 5 stops per route and unlimited route history. Features may change over time; we won't remove core Pro features during a period you have paid for.
Subscription terms.
- Mapbreak Pro is an auto-renewing subscription, billed yearly or monthly through your Apple Account. The price and period are shown in the app before you confirm.
- The yearly plan may include a free trial for eligible new subscribers (currently 7 days). Apple decides eligibility. If you don't cancel at least 24 hours before the trial ends, the subscription starts and you are charged.
- Payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends.
- Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Renewals are charged within the 24 hours before the period ends.
- Manage or cancel in Settings > your name > Subscriptions. Canceling stops future renewals; Pro stays on until the end of the paid period.
- Any unused part of a free trial ends when you buy a subscription.
- Refunds are handled by Apple under its policies (reportaproblem.apple.com); we can't issue App Store refunds.
- If a price changes, Apple notifies you as its rules require; where required, the new price applies only after you agree.
- If a payment fails, Apple may retry and keep Pro on for a grace period; if it stays unpaid, Pro ends. If a purchase is refunded or reversed, Pro is removed.
6. Third-party services
Mapbreak works with services we don't control. By using Mapbreak you also agree to:
- the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy, because Mapbreak uses Google Maps Platform data;
- Google's terms for the Google Maps app, when you open routes there;
- Apple's terms for the App Store and for maps shown in the app (MapKit).
Google Maps is a trademark of Google LLC. Mapbreak is independent and is not affiliated with, sponsored by or endorsed by Google.
7. Acceptable use
Don't: copy, scrape or bulk-download place data from Mapbreak; access our servers except through the app; reverse engineer, resell or modify the app; work around the free-route limit or subscription checks; interfere with or overload the service; use Mapbreak for anything unlawful.
8. Our content
Mapbreak, its logo and its design belong to ScaleOn Limited. Third-party content belongs to its owners and is shown under their licenses, with their attribution. If you send us feedback, we may use it without obligation to you.
9. Availability and changes
We may update, suspend or discontinue features, and we may suspend access if you break these Terms. If we discontinue Mapbreak Pro, we will tell you in advance.
10. Disclaimers
Mapbreak is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or enjoyment, arising from your use of Mapbreak, including trips, stops or businesses you choose. Our total liability is limited to the greater of the amount you paid for Mapbreak Pro in the 12 months before the claim, or US $50. Some states don't allow these limits, so they may not apply to you.
12. Indemnity
If you break these Terms or the law while using Mapbreak and that leads to a third-party claim against us, you agree to cover our reasonable losses from that claim, to the extent the law allows.
13. Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. Before filing any claim, contact us at support@mapbreak.com so we can try to resolve it informally.
14. Apple App Store terms
- These Terms are between you and ScaleOn Limited, not Apple. ScaleOn Limited, not Apple, is responsible for Mapbreak and its content.
- Your license to use Mapbreak is limited, non-transferable and for Apple-branded devices you own or control, as allowed by the App Store Usage Rules (Family Sharing is not offered for Mapbreak Pro).
- ScaleOn Limited alone provides maintenance and support; Apple has no obligation to do so.
- If Mapbreak fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price paid, if any. To the maximum extent the law allows, Apple has no other warranty obligation for Mapbreak.
- ScaleOn Limited, not Apple, handles any claims about Mapbreak, including product liability, failure to meet legal or regulatory requirements, consumer protection, privacy and intellectual-property claims.
- You confirm that you are not in a country subject to a US government embargo or designated as "terrorist supporting", and that you are not on a US government list of prohibited or restricted parties.
- You must follow applicable third-party terms (for example your mobile carrier's) when using Mapbreak.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Changes to these Terms
We may update these Terms. We will change the effective date and tell you in the app before material changes take effect. Continuing to use Mapbreak after that means you accept the updated Terms.
